En donde se indica la fuente, dice que es de la Colección Austral, 1975, pero no encontré ninguna referencia que la traducción es de 1928, que no garantiza eso que esté libre de derechos según las políticas de Wikisource. Tampoco hay referencias de fecha de fallecimiento y nacionalidad del traductor, por lo que queda indeterminado. No necesariamente textos provenientes de cervantes virtual, implican que sean compatibles con Wikisource:Derechos de autor. Shooke (discusión) 14:27 18 may 2022 (UTC)Responder

I agree that, even if that translation was published in 1928, the translator died much later, and its exclusive author rights are still not extinct. But we lack basic biographic data about the translator (when did he die? It's unlikely to be living today, as such work on antique languages requires extensive knowledge, and would not be published before the translator got at least 20 years old, so the translator is very likely not born after 1908 and he would be 112 years old today in 2022 and would be wellknown, due to his age and problably lot of other publications about philosophy and classic Greek, or comments by those discussing with him for his translation). Nothing prohibit that translator to have been living still in 1975 (when the Austral Collection was published to include that translation) and even several decenials later (and then his work is unlikely to be free of copyright before 2050-2070, possibly more according to Spanish law).
An in fact the statement that this was translated in 1928 is unsourced, we only see a publication in 1975 and the name of the translator, and have no indication about if this was a collective work for the collection (in which case the starting date of copyright is 1975, not 1928, and the coyright will not end before 2050), or was individual (the personal copyright would be extended for possibly several other decenials). For all those reasons, that work is NOT free of copyright, and may be a case of copyvio on Wikisource (we don't know exactly what is the copright status of the online publication in Colección Austral, they may have the appropriate authorization, but it's not up to Wikisource to reproduce it: we need an explicit authorization by Colección Austral, or by the effective translator or its successors).
Wisource has other translations for which we are sure that their copyright is now extinct (a new free Spanish translation could still be created in e.g. Wikibooks, based on the original Ancient Greek text, available on Wikisource, and compared to other free translations available, most of them using modern languages but published before 1910 or in the 19th century and created by translators for which we have a trusted biography; note that the Russian copyright is 100 years, so there should not be any Russian translations created in the 20th century... On the opposite, the existing French, English and Polish translations in Wikisource are legit). Verdy p (discusión) 19:14 16 dic 2022 (UTC)Responder
